ShaggySwag, Inc. (“we,” “our,” or “us”) respects the privacy of visitors and customers to www.shaggyswag.com (the “Site”). This Privacy Policy outlines the information we collect and how we use that information. This Policy also tells you how to review the accuracy of your Personally Identifiable Information (defined below) submitted to us and how you can request that we delete or update your Personally Identifiable Information.   

Information We May Gather

Generally: We collects contact information from users who are registered to use our site, including name, company affiliation, phone number and email address. We may also collect certain information automatically, such as information about: (i) your mobile device or computer and its capabilities, including, without limitation, the operating system, the applications or programs on your mobile device or computer, IP address, device carrier, device type, time zone, geographic location, network status, browser type, browser identifier, unique device identification number, carrier user ID (a number uniquely allocated to you by your network provider), media access control address, international mobile equipment identity, locale and other information that alone or in combination may be used to uniquely identify your mobile device or computer; and (ii) your activities in connection with the Site.   Specific Information: In addition, we collect information from registered users during and after registration. Registered users and visitors may also voluntarily provide information, including without limitation, in the form of comments, survey responses and testimonials. When you sign up, register, join, participate in, or opt-in to a blog or survey, contest or promotion, you will be asked to provide certain contact and demographic information, including, without limitation, your name, address(es), telephone number(s) (including home, cell, and/or business telephone numbers), email address(es), credit card number and expiration date (“Personally Identifiable Information or PII”). Certain applications, including ShaggySwagBuddy, may require you to log in through your Facebook account. If you link your Facebook account to a ShaggySwag service, this allows us to obtain information from those accounts (such as your friends or contacts). The information we obtain from those services often depends on your settings or their privacy policies, so be sure to check what those are. If you purchase a product or service from us, including through the ShaggySwagShop, we request certain PII from you on our order form.   Permitted Disclosures: We may disclose PII and other information collected through the Site to third parties in any of the following circumstances:   1. With your consent. 2. Pursuant to applicable law or regulation or in response to a subpoena or an order of a court or government agency. 3. To establish, exercise, or defend against legal claims of ours or another individual, including in order to protect the safety of our or an individual’s rights and/or property. 4. To our parent, subsidiary, or affiliate: (i) in the event of a reorganization or restructuring, or (ii) for use and processing in accordance with this Privacy Policy. 5. To our authorized agents and/or subcontractors who are providing services, including, without limitation, data append services, data validation services, fraud detection and/or prevention services, database-matching services, coding services, data segmentation services 6. To our product suppliers and manufacturers, in connection with a testimonial, blog comment or your participation in a contest or promotion or completion of a survey and/or 7. In connection with a change of ownership or control, including, without limitation, a merger or an acquisition of any or all of our business assets, provided that the party receiving or acquiring PII or other information agrees to use, protect, and maintain the security, integrity, and confidentiality of PII and other information collected through the Site in accordance with this Privacy Policy.   

Other Ways We May Use Your Information We may use the information we automatically receive from your web browser to see which pages you visit within the Site, which site you visited before coming to ours, and where you go after you leave. We can then develop statistics that are helpful to understanding how this site is used by our visitors. This statistical data is interpreted by us in our continuing effort to present the web site content that visitors are seeking in a format they find most helpful. We may use your phone number and email address to fulfill orders you submit, send you invitations to participate in surveys and to contact you with additional offers relating to our products. When you complete a survey, your responses are analyzed in aggregate with all other respondents’ information and may be used and shared with third parties for any lawful purpose.  

Use of Cookies and Web Beacons

Like many other websites, we use cookies to provide a better experience for our members. We limit their use for quality control and validation. Cookies are used temporarily during the time you are actively completing a survey or filling out the registration forms and we do not store or retain your cookie information in any way. No PII is transmitted via these cookies. You can also delete cookies from your computer or device. However, if you choose to block or delete cookies, certain features of the Platforms may not operate correctly.   We also may use an application known as a "web beacon" (also known as a "clear gif" or "web bug"). A web beacon is an electronic file that usually consists of a single-pixel image. It can be embedded in a web page or in an email to transmit information, which could include personal information. For example, it allows an email sender to determine whether a user has opened a particular email.   Third-party online tracking and behavioral advertising. We also may partner with certain third parties to collect, analyze, and use some of the personal and non-personal information described in this section. For example, we may allow third parties to set cookies or use web beacons on the Platforms or in email communications from us. This information may be used for a variety of purposes, including online behavioral advertising, as discussed above.   

How We Respond to Do Not Track Signals  We do not track across third party websites to provide targeted advertising and therefore do not respond to Do Not Track (DNT) signals.   

Data Security

We take the security of your information seriously. We will not activate a potential registrant’s account without confirmation. Once the registration process is completed, the individual is sent an email requesting that he or she confirm his or her registration. The account will not be activated until confirmation is received. You are required to use your password and username when registering, update your contact information. If you forget your password, you can send a message to our secure system to retrieve it.   We have security measures in place to prevent the loss, misuse, and alteration of the information under our control. We employ commercially reasonable technology and internal processes to protect the information our members release to us. If, despite our security measures as described in this policy, we suffer a breach of our security systems and an individual or entity gains unauthorized access to any information stored on our servers, we will investigate such security breach, and will provide notice to any affected individual in accordance with applicable laws. 

Children’s Privacy

We believe that it’s especially important to protect children’s privacy online and encourage parents and guardians to spend time online with their children to participate and monitor their Internet activity. If you have provided us with personal information about a child iwho is under the age of 13, a parent or guardian of that child may contact us at the email address or mailing address listed at the bottom of this Privacy Policy if he or she would like this information deleted from our records. We will use reasonable efforts to delete the child’s information from our databases.

When taking a survey, you may have the opportunity to link to other web sites. We are not responsible for the privacy policies or practices of those sites. We recommend that you carefully read the privacy policies of each site you visit. Reviewing and Updating your information If you want to learn more about the personal information that ShaggySwag has about you, or you would like to update or change that information, or deactivate your account, please contact us by email at [email protected]   Note that deactivating your account does not cause your account information to be deleted from our servers. You can request such deletion by emailing our Customer Support team at [email protected]  Users from outside the United States The personal and non-personal information that we collect through or in connection with the Site is transferred to and processed in the United States for the purposes described above. We may also subcontract the processing of your data to, or otherwise share your data with, affiliates or third parties in the United States or countries other than your country of residence. The data-protection laws in these countries may be different from, and less stringent than, those in your country of residence. By using the Site or by providing any personal or non-personal information to us, you expressly consent to such transfer and processing. Transfer of Information   We reserve the right to transfer your PII and Sensitive Data to a buyer in connection with a sale of stock or assets, merger, or any other change of control transaction. Any acquirer would be required to honor our privacy policy.   

Governing Law

This Privacy Policy is governed by the laws of the State of New York, without regard to its conflicts of law principles.   

Changes to This Policy

We will use information in accordance with the privacy policy under which the information was collected. If we are going to use users’ PII in a manner different from that stated at the time of collection, we will notify users via email. If users have opted out of all communication with the site, or deleted/deactivated their account, then they will not be contacted, nor will their PII be used in this new manner. Current community/panel members will be notified of any changes to this privacy policy via e-mail or via a message posted on our website.
